Terms of use
1. About these terms
These terms are an agreement between you and [[OPERATOR_NAME]] (“we”, “us”) about your use of the Lapboard website, portal, servers and any software or timer licences we provide (together, “Lapboard”). By creating an account or using Lapboard you accept these terms. Our privacy policy explains how we handle your information.
2. Who can use Lapboard
- Lapboard is invite only. You need a valid invite code from a group admin or from us.
- You must be 18 or over, and you must hold any licence, permit or insurance the law or an event organiser requires for what you do.
3. Your account and timer licence
- Keep your password secret. You are responsible for activity on your account.
- One account is for one person. Don’t share it.
- A licence number activates one timer on your account. It is personal to you and can’t be sold, shared or transferred without our agreement. We may revoke a licence if these terms are broken.
- Tell us promptly if you think your account or timer has been compromised.
4. Acceptable use
You must not:
- upload laps you did not record yourself with your own activated timer;
- alter, fabricate or replay timer records or GPS data, feed a timer a false GPS signal, or otherwise try to get a lap ranked that you did not drive;
- try to bypass, probe or overload our checks or security, or access anyone else’s data;
- use Lapboard for anything unlawful, or to harass, threaten or defame anyone;
- upload tracks or data about locations you don’t have permission to use.
5. Lawful and safe use
- Closed courses and permitted events only. Lapboard is for closed courses and events where timing is permitted. You must not use it to organise, promote, take part in or record racing, speed trials or any contest of speed on public roads.
- Obey the rules. You are responsible for following the road rules, the laws about in-vehicle screens and devices, event regulations, venue rules and your insurance conditions.
- Don’t be distracted. Set up the timer and screen before you move. Don’t operate controls or read the screen while driving. Mount equipment securely, away from airbag deployment zones and your line of sight, so that it can’t become a hazard.
- Risk. Motor sport is dangerous and can cause injury or death. You take part at your own risk. We don’t supervise, certify or insure any event or activity, and Lapboard is not a safety device.
6. Your data and our licence to use it
You keep ownership of the data you upload. You give us permission to store, process and display it as needed to run Lapboard: to check your laps, rank them, show results to the members of your groups, keep the service secure and make backups. You promise you have the right to give us that permission. You can ask us to delete your data at any time (see the privacy policy).
7. Verification, rankings and accuracy
- “Verified” means our automated checks found the GPS data consistent with the claimed time. It is not a guarantee that a time is exact or that no one has cheated.
- GPS timing has limits. Times are typically uncertain by around a tenth of a second, so close results can’t be reliably separated.
- Lapboard is not official timing. Don’t rely on it for official results, protests, penalties, prizes, insurance or legal purposes.
- We may change the checks, re-check laps, and remove or hide a lap or result if we suspect it is wrong or has been tampered with. Rankings can change as a result.
8. Availability and changes
Lapboard is a small project in development. We try to keep it running but don’t promise it will always be available, error-free or kept for any particular time. We may change, suspend or end it. If we plan to close it, we will try to give members notice and a chance to ask for a copy of their data.
9. Suspension and ending
We may suspend or close your account, revoke your timer licence or remove your results if you break these terms or put others or the service at risk. You can stop using Lapboard at any time and ask us to delete your account.
10. Responsibility
- Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
- Subject to that, and to the extent the law allows, Lapboard is provided “as is”. We are not liable for loss or damage arising from your use of Lapboard or from motor sport activities, including injury, vehicle damage, loss of data, incorrect or missing results, or interruptions to the service.
- You are responsible for your own actions and for any loss or damage you cause to others by breaking these terms.
11. Governing law
These terms are governed by the laws of [[GOVERNING_STATE]], Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.
12. Changes to these terms
We may update these terms. We will post the new version here with a new effective date, and tell members if the changes are significant. If you keep using Lapboard after a change takes effect, you accept the new terms.
